Supreme Court Slaps Wilmar Subsidiaries with Rp11.8 Trillion Fine; Company Considering Judicial Review

InfoSAWIT, SINGAPORE — The Supreme Court (MA) officially overturned the acquittal of the three major palm oil groups—Wilmar Group, Permata Hijau Group, and Musim Mas Group—after granting the cassation appeal from the Attorney General's Office. The ruling, uploaded to the MA's official website, states that five Wilmar subsidiaries were handed fines and ordered to pay compensation for state losses.

In an official statement obtained by InfoSAWIT on Monday (9/29/2025), the five Wilmar subsidiaries named are PT Multimas Nabati Asahan, PT Multi Nabati Sulawesi, PT Sinar Alam Permai, PT Wilmar Bioenergi Indonesia, and PT Wilmar Nabati Indonesia. They were each fined Rp1 billion and ordered to pay total compensation of Rp11.88 trillion (equivalent to approximately USD708 million).

The breakdown of the compensation includes profits obtained by the companies (Rp1.69 trillion), state losses (Rp1.65 trillion), and losses to the business and household sectors (Rp8.52 trillion). Wilmar stated that this amount had actually been deposited with the Attorney General's Office and would later enter the state treasury.

In its statement, Wilmar expressed respect for the MA's decision but regretted the ruling. “The actions taken by Wilmar’s subsidiaries during the domestic cooking oil scarcity were in accordance with applicable regulations and were done in good faith,” the Wilmar management wrote. The company is also considering the option of filing a judicial review (Peninjauan Kembali - PK).

Following this verdict, Wilmar anticipates recording a net loss in its third-quarter financial report ending September 30, 2025. Nevertheless, the company still forecasts booking a profit for the full year ending December 31, 2025. Wilmar also urged shareholders and potential investors to exercise caution when making decisions regarding the company's stock. (T2)
